The Physician Payments Sunshine Act requires health care product manufacturers to report to the federal government payments more than $10 to physicians. Bringing unprecedented transparency to medicine, PPSA holds great potential for enabling medical stakeholders to manage conflicts of interest and build patient trust—crucial responsibilities of medical professionalism. The authors conducted six focus groups with 42 physicians in Chicago, IL, San Francisco, CA, and Washington, DC, to explore attitudes and experiences around PPSA. Participants valued the concept of transparency but were (...) wary of the law's design and consequences. They downplayed PPSA's potential and felt it undermined public trust. Showing broad unawareness of COI, they dismissed the notion of industry influence and welcomed company “perks.” Misapprehensions may leave physicians unprepared to advance the opportunities PPSA holds for professionalism. The most recent (Fifth) revision of the Declaration of Helsinki, adopted in October 2000 by the World Medical Association (WMA), reinforces the longstanding prohibition against offering placebo instead of effective therapy. The WMA left no doubt that if a beneficial treatment for a condition has already been recognised, it is unethical to offer placebo in place of such treatment to anyone in a study of the same condition. We have previously drawn attention to the discrepancy between the spirit of the (...) Declaration and the common practice of using placebo controls in randomised trials even if effective treatment exists. Despite the mandates of the Declaration of Helsinki and concern from ethicists and scientists, the US Food and Drug Administration (FDA) continues to demand and defend placebo‐controlled evidence of efficacy and safety for the development of many new pharmaceuticals, even if effective therapy exists. We suggest that the FDA's arguments defending their practice are insufficient to justify medical research that violates the Declaration of Helsinki. (shrink)

Addresses the issues at the heart of international medicine and social responsibility. A number of international declarations have proclaimed that health care is a fundamental human right. But if we accept this broad commitment, how should we concretely define the state’s responsibility for the health of its citizens? Although there is growing debate over this issue, there are few books for general readers that provide engaging accounts of critical incidents, practices, and ideas in the field of human rights, health care, (...) and medicine. Included in the book are case studies of such issues as AIDS among orphans in Romania, organ trafficking, prison conditions, health care rationing, medical research in the third world, and South Africa’s constitutionally guaranteed right of access to health care. It uses these topics to address themes of protection of vulnerable populations, equity and fairness in delivering competent medical care, informed consent and the free flow of information, and state responsibility for ensuring physical, mental, and social well-being. We provide an empirical investigation of leadership characteristics and social justice issues in the context of financial literacy service-learning. Using a unique dataset of student self-ratings, we find that students experience statistically significant increases in 8 of the 10 leadership dimensions and 7 of the 7 social justice issues examined in this study. Leadership dimensions include: persuasion, building community, “commitment to the growth of people,” stewardship, empathy, awareness, foresight, and listening. Interest in social justice issues include: dignity of the human (...) person, community and the common good, rights and responsibilities, option for the poor, dignity of work, solidarity, and care for God’s creation. The statistically significant increases in these dimensions following the completion of the service-learning suggest positive effects on students’ self-perception of leadership qualities and interests in social justice issues: business school students sense improvement in nurturing growth of employees and colleagues, commitment to serving the need of others, understanding and empathizing with others, ethics, ability to foresee the likely outcome of a situation, and listening intently to others. As a consequence of the financial literacy service-learning, we believe that business students become more prepared toward becoming ethical leaders and citizens with compassion to serve the world for the well-being of all people, rich and poor alike. Eusebius’s episcopal list places Ignatius as the third bishop of Antioch, after Saints Peter and Evodius, reigning in Antioch from ca. 70 to 107. Ignatius was a larger-than-life character; even as a child he was supposedly the little boy whom the Lord embraced and held up as an example of heavenly simplicity (Matt 18:2-4). In ten clear and illuminating chapters, Gregory Vall brings the reader through the many legends and apocryphal assumptions surrounding Ignatius and his thinking. Vall’s purpose in writing this work is to show contemporary scholars the levels of richness and theological insight in Ignatius’s relatively small epistolary corpus.The first two chapters treat Ignatius’s use of Scripture and how his reading of the canon plays out in his theology of salvation. “Scripture and Economy” (chap. 1) and “Issues in Ignatian Scholarship” (chap. 2) show not only the massive amount of scholarly attention such a relatively small amount of writing has generated over the centuries, but also why the way Ignatius read and [End Page 321] used Sacred Scripture is still important today. Accordingly, here we become the students of one who sees himself teaching on behalf of Jesus Christ. This is ecclesia for Ignatius, a place where those called out of the world come together as one so as to be illumined into true Christ-bearers. For Ignatius, therefore, “theology is properly an ecclesial activity and not merely the function of isolated individuals. Yet, surely, truth in advertising is an uncommon virtue. The frank honesty of Jeffrey Bloechl, the editor of this volume, is much to be commended.What unifies the essays in this volume is not a common topic or a common approach but a common concern with the problem of understanding the relation between Christianity and secular reason. The issue in play is how much respect a religion that claims to be the recipient of divine revelation owes to autonomous reasoning in any particular age. The problem is exacerbated in those periods of history that are marked by strong claims for the powers of human reasoning.Bloechl’s introduction is particularly helpful due to its distinction between secular reason and secularized reason. Unless a believer takes the fideist position of holding that only claims grounded in faith are valid knowledge-claims, there is no reason to deny or cast skeptical aspersions on secular reason. The term simply names the use of reason according to its proper governing principles on any topic where the justifications for various truth-claims are drawn only from this-worldly experience and, for disciplinary reasons, make no use of divine revelation. It is the type of reasoning that is done within a saeculum, that is, within a given period of time, according to the canons of sound reasoning operative in that epoch. The term “secularized reason,” by contrast, names the view of reason that is hostile to the legitimacy of any knowledge-claim that involves the testimony of divine self-disclosure as its warrant. The proponents of secularized reason often conveniently overlook the likelihood that such hostility risks begging the question by disallowing any form of divinely backed testimony in principle, while allowing human testimony in such spheres as history or courts or law. If one is prepared in general to accept testimony as a justification for a truth-claim, then the proper criterion is the credibility of the source. But then there is no principled way to preclude in advance the possibility that testimony that originates with God might provide the strongest possible type of warrant for certain knowledge-claims. It is mere prejudice to decide in advance that this alternative is simply beyond the pale of consideration.Threaded through the essays in this volume is the perennial problem of the relationship of faith and reason. Earlier ages posed the problem on their own terms, sometimes quite different from modern assumptions. Readers unfamiliar with the thought of Thomas Aquinas, for instance, might well be [End Page 141] surprised to learn that the very first question of the Summa theologiae asks whether any sort of sacra doctrina is necessary beyond the philosophical sciences. Such a stance does not raise a question about whether faith can be a genuine source of knowledge, but merely asks if there is need for the sort of knowledge that is grounded in faith. Aquinas answers the question not only by reflecting on the difficulties that arise from expecting that everyone will have the necessary time, interest, and intellectual resources to figure out for themselves the things that they need to know for the sake of salvation; he also notes certain areas that are entirely beyond the scope of unaided reason, such as knowledge about the triune nature of God.By contrast, the proponents of secularized reason tend to cast doubt on the very possibility that any truth-claim based on religious faith could even be counted as knowledge. Metaphysicians go on busily doing metaphysical thinking all over the world, and apparently with a modicum of self-assurance that they are not talking nonsense or pursuing an illusory will-of-the-wisp. Yet other philosophers of empirical, analytical, phenomenological, or other turns of mind seem to have more and more difficulty in understanding just how metaphysicians give meaning and positive content to the vast abstract concepts by which they seek to describe and explain the entire spectrum of reality extending far beyond present or (...) perhaps even possible human experience. Since there is no way of gaining direct insight into dimensions of reality beyond human experience, and since in order to be applied to the whole range of reality these concepts must abstract from purely human experience, it is hard for them to see—and it is a serious problem in itself—how these all-embracing terms can be anything more than empty, formal, verbal symbols or conceptual constructions, with no positive existential content describing reality itself across its whole spectrum. Even the metaphysician himself, though when left alone he may have a sure sense of how to do metaphysical thinking fruitfully, when questioned to explain and justify what he is doing, and is convinced is worth doing, can feel embarrassed and struck dumb as to how to articulate and justify the principles behind the procedures he is following. Boston College April 2002 Iwill arrange my comments under four headings: (1) what we had hoped to accomplish; (2) what we actually did accomplish; (3) what we may have learned from this; (4) what this might now enable us to do in thefuture. This epilogueisbeingwritten in April, 2002,twenty-twomonths after the conference. To draw what good we can from this delay, writing at this distance (...) allows me to summarize and draw conclusions with, perhaps, a bit more balance. On the other hand, my listening again to the audio record in the course ofpreparing this publication has enabled me to relive something of the original experience. (1)As I indicated in the introduction, we had unrealistically hoped that, by the time ofthe conference, the five presenters, and perhaps also the twoprincipals inthe "Girard-Lonergan Conversation," wouldhavealready exchanged with each other not just first drafts, but even second drafts of their papers, and that the conference itself would then be invited to join a conversation that was already well under way. As it turned out, I couldn't muster the organizational skills and resources needed to achieve this. But reflecting after the fact, I can see that so carefully detailed a preparation might have been counterproductive. Carrying out our original plan might have been at the cost ofimposing more ofa Western analytic pattern on our discussion ofother traditions, and of!thus smothering from the outset some of the insight that did occur. We had also hoped that the opening "Girard-Lonergan Conversation" would provide an analytic resource for the rest of the meeting. But that did not happen to any great extent. (2)The proximate preparation for this conference began with a draft version ofmy paper being sent to the other major presenters. I opened with 194Robert J. Daly, SJ. a series of brief sketches of salient points in the often unhappy but also occasionally felicitous history ofChristianity on this theme ofviolence and institution. Then, after emphasizing the importance of distinguishing between the normative and the descriptive, I tried to make some sense, both rational and theological, of all this data, especially by reflecting on the influences and consequences ofthe belief in hell, on the one hand, and the hope of universal salvation, on the other. The next major religious theme was Judaism. Reuven Kimelman provided a detailed—and, for some, overwhelming—glimpse of the way the talmudic traditions deal with the theme of war and its restrictions. This highly text-oriented and interpretation-of-texts driven presentation seemed to many, at first, to be irrelevant to mimetic theory and to the need to be confronting actual violence. But, in the course of Sandor Goodhart's response, and in the course ofthe at times spirited discussion that followed, we began to understand that how one interprets texts and traditions, and how these are played off against each other, is indeed fundamental to the way Jews typically try to deal with the practical challenges of violence. Qamar-ul Huda's presentation on IsIamfocused stronglyonthe way the spiritual teachings of Islam—i.e., islam as a religion rather than Islam as a political or national institution—foster peace. The initial reaction was somewhat similarto the reaction to Kimelman's paper: disappointment that Huda was not talking more directly about contemporary Muslim extremist violence. But here, too, the discussion enabled us to catch a glimpse both of the inner spiritual resources of Islam, and of the limitations ofthe range of concerns that Westerners typically bring to the table. Francis Clooney, in his presentation ofHinduism, strongly emphasized the great variety in Hinduism, stressing that one cannot speak ofHinduism as such. Much of this variety comes from the several millennia of Hindu history, and from the complex relationships to Buddhism and Jainism which, themselves, are important parts of Hindu history, and also from the fact that only recently have Hindus, after centuries of Moslem or Colonial domination, once again returned to positions of political and military power. Finally, Christopher Ives's presentation on Buddhism, in a way similar to my presentation on Christianity, but more extensively or more consequently, pointed out the various ways in which Buddhism has been politically and... The translation of the work is quite adequate, though there are some places where it misses the nuance of Geffre's text, as when it asserts that "there is no knowledge..." (p. 14), instead of saying (...) that "it [discourse] is not a knowledge" (French edition, Paris, 1983; p. 23). It can also tend to render the text unintelligible, as when it speaks of "our habit of judging... the exclusive place of theological truth" (p.54), instead of "our habit of making judgment ••• the exclusive place of theological truth " (French edition, p.76·77). Then, there are moments when it simply says the opposite of what the author intends. Thus Thomas Aquinas is presented as one of those who tend to replace the authority of Scripture with the authority of the magisterium (p.48) instead of being distinguished from them (French edition, p.68), and scientific exegesis and historical method are credited with helping to " bridge the gulf " between exegetes and theologians (p.13), instead of being criticized for helping to " dig the ditch (creuser le fosse) " that separated them (French edition, p.21). Geffre concludes his book with an epilogue where he comments both critically and hopefully on the recent history of Catholic theology in France. In this he is able both to review the major themes of the book and to establish a challenging program for future work in hermeneutical theology. Despite the reservations I have mentioned concerning some of his views, I think it can be said that Ge:ffre's careful scholarship and insightful arguments, combined with is penetrating grasp of the contemporary theological scene which is evident in his copious notes and references, may represent one of the first flowers of the " new theological spring " of which he speaks. His underlying thesis is that psychoanalysis, especially in its later ego-psychology and object relationships developments, has insights to contribute to the psychology of religion, and, along with other psychologies of development, clarifies and concretizes the understanding of religion-as-lived, counterpointing the contributions of theology. The book has three sections. In the first section, the author reflects on a psychology of grace, and sets up a developmental schema of the steps toward spiritual identity, paralleling Freud's psychosexual stages and Erikson's psychosocial stages. He conceptualizes the psychospir· itual stages in terms of the theological virtues, partially subdivided into Gospel virtues, and two of the cardinal virtues. Thus his eight stages emerge as faith/hope, contrition, penance/temperance, fortitude, hu· mility, love of neighbor, service/zeal and charity. Prudence, presum· ably, would relate more to a Piagetian schema, although prudence would certainly also be affected by areas of psychological conflict, while justice would probably be considered a superego derivative. The second section of the book deals with faith/hope, the first stage of psychospiritual development. The author uses Kierkegaard's analysis of faith as his theological standard. Whether this understanding of faith, in which the formal motivation is absurdity, is preferable to a faith whose formal motive is "because nothing is impossible for God," is debatable. In any event, Kierkgaard's faith would seem to belong more to a stage of final purification than to any earlier developmental phases. In presenting the stages of faith development, Meissner uses Fow· ler's schema, based on -Piaget's and Kohlberg's studies, (cognizant of Rothman and Lichter's criticisms in terms of the influence of sociopolitical ideologies, but making no reference to Loevinger's critique from women's perspectives), along... Josef Pieper’s insight into Aquinas’s metaphysics, that “createdness determines entirely and all-pervasively the inner structure of the creature,” applies equally to philosopher William Desmond.1 For at the heart of Desmond’s metaphysical project lies a refusal to take creation for granted, a challenge to Bertrand Russell’s assertion that “the universe is just there, and that’s all.”2 Desmond work aims at “renewing metaphysical astonishment before the enigma of being that was, and is, and always will be too much for us, in excess (...) of our groping efforts.”3 This “enigma of being” arouses a sense of astonishment at creation’s givenness, “that it is,” and at creation’s contingency, for all that is “might not have been .. When Dr. van Fleteren writes of the articles I criticized as dating from some twenty years ago, the unwary reader might infer that my criticism of those articles was, for its part, relatively recent. The fact is, however, that when the two connected articles I eventually criticized appeared in the volumes of Augustinian Studies, I wrote this reply while Fr. Robert Russell, of happy memory, was still at the helm, and was promised publication in the near future. Meanwhile, however, Fr. (...) Russell had the discourtesy to move on to a more intimate acquaintance with Augustine than any of us on this confused planet can boast of, and someone sowed cockle into field he had tended: in unaccountable fashion my article seems to have disappeared. Only a recent letter of inquiry on my part, and Fr. Allan Fitzgerald’s understanding reply, resulted in this renewal of dialogue between Dr. van Fleteren and me. This article considers the theme of discernment in the tradition of Ignatian spirituality emanating from the Spiritual Exercises of St Ignatius of Loyola, the founder of the Society of Jesus. After a brief introduction which addresses the central problematic of bad influences that manifest themselves as good, the article turns to the life and work of two Jesuits, the 16th C English missionary to India, Thomas Stephens and the 20th C French historian and cultural critic, Michel de Certeau. Both kept (...) up a constant dialogue with local culture in which they sought authenticity in their response to ‘events’, whether a hideous massacre which shaped the pastoral commitment and writing of Stephens in the south of the Portuguese enclave of Goa or the 1968 student-led protests in Paris that so much affected the thinking of de Certeau. Very different in terms of personal background and contemporary experience, they both share in a tradition of discernment as a virtuous response to what both would understand as the ‘wisdom of the Spirit’ revealed in their personal interactions with ‘the other’. Graebe (Steubenville, OH: Emmaus Academic, 2021), 351 pp.Though Mary's undiminished virginity in giving birth (virginitas in partu) was long understood to be an event as miraculous and a teaching as authoritative as her virginity in conceiving (...) (virginitas ante partum), virginitas in partu underwent a kind of existential reinterpretation in the middle of the twentieth century. Authors such as Albert Mitterer and Karl Rahner suggested that, physically speaking, Jesus's birth might have happened like any other, rupturing the hymen, distending the birth canal, and causing Mary pain, albeit not in the spiritually disintegrating way common to postlapsarian humanity. These arguments effectively "unsettled" the traditional understanding of virginitas in partu, leading theologians of the highest stature to distinguish between the doctrine itself and the anatomical aspects attached to it over time. Fr. Brian Graebe has written a fine book arguing that the bodily dimensions of the virgin birth, including the physical "seal" of virginity, belong to the substance of the doctrine. This more inclusive understanding not only does better justice to the data of tradition, he argues, but illuminates the ecclesiology of the Second Vatican Council. The book impresses by its theologically reflective method, its clarity of exposition, [End Page 1106] and its depth of research—especially into the archival and antepreparatory sources of Vatican II.Vessel of Honor responds in effect to Rahner's argument that physical intactness is peripheral to the dogmatic core of Mary's virginity in partu. To show otherwise, Rahner contended, one would need to show that such a doctrine can be found directly in the apostolic teaching, or that it, "being implicitly contained therein, has grown out of the apostolic doctrine, by a legitimate historical, logical, and theological process, as its authentic development" (68–69). If the bodily aspects of this doctrine really belonged to the deposit of faith, in other words, one would need to show how they are implied in the traditio divino-apostolica, as well as how they cohere organically with the rest of the deposit. The two major parts of Vessel of Honor respond in turn to each aspect of Rahner's challenge.The first three chapters argue that Mary's bodily integrity in parturition belongs at least implicitly to the traditio divino-apostolica. Turning first to the postapostolic tradition, Fr. Graebe shows that—apart from the early exceptions of Origen and Tertullian—patristic sources either affirm or strongly imply a miraculous delivery. This constant witness culminates in the Lateran Council (649 AD), which, while not itself an ecumenical council, was received into the magisterium of Pope Martin and affirmed by the Third Council of Constantinople (680 AD). Its teaching that Mary "gave birth without corruption" (incorruptibiliter... genuisse) would be defended by Paschasius, Ratramnus, Thomas Aquinas, and others. This consensus remained undisturbed until the eve of Vatican II.Even at Vatican II, Fr. Graebe argues in the next chapter, the Council Fathers intended to reaffirm the more inclusive idea of virginitas in partu against those who would marginalize its bodily dimensions. Here he really breaks new ground, delving deep into the antepreparatory, preparatory, and conciliar drafting history. Graebe shows that some of the very theologians who voted to omit the pointed phrase "in the birth itself" (in ipsomet partu) did so for tonal rather than substantive reasons.The third chapter argues that Mary's physical integrity in birth is to be believed with divine and Catholic faith, despite the ongoing confusion introduced by Rahner and others.
